The language below is drawn from the required liability and media release waivers that must be signed by participants in order to attend Alasdair Fraser’s Sierra Fiddle Camp. Every adult attendee is required to individually sign the waiver and media release; legal guardians of minors must sign for any children attending camp.

Participants (“Participant”) choose to participate in ALASDAIR FRASER’S SIERRA FIDDLE CAMP (the “Activity”), organized by SCOTTISH FIDDLERS OF CALIFORNIA, and hosted at Shady Creek Outdoor School and Event Center in Nevada City, CA. By attending, participants (or parents/legal guardians of minors) acknowledge and accept the following:

General Risk Disclaimer

The Activity takes place at a sleep-away/overnight campsite in a forested area with wildlife and facilities for physical and musical activities. Attendees are of all ages, and wine and beer are available for purchase by attendees over the age of 21.

Participation in the Activity, use of its facilities, or engagement with its attendees carries inherent risks, including but not limited to potential property loss, illness, pain, economic or emotional loss, and serious physical and/or psychological injury (including disfigurement, paralysis, and death). These risks may arise directly or indirectly from a participant’s own actions, the actions or inaction of others, or the conditions of the Activity’s location.

The Camp and its affiliates are not responsible for any such risks or outcomes associated with participation in the Activity.

Medical Disclaimer

The only medical care provided at the Activity is basic first aid and supplies for minor injuries and illness. In the event of a medical emergency, first responders may be several minutes away.

Participants (or their guardians) are responsible for disclosing any medical limitations or medications during registration and for ensuring that they or their child are medically able to participate.

The Camp may, in emergency situations, arrange for or facilitate medical care deemed necessary, including but not limited to diagnostics, first aid, CPR, AED use, emergency transport, hospital admission, or procedures. However, the Camp and its affiliates are not responsible for the outcome of such care.

All costs associated with medical treatment—emergency or otherwise—remain the sole responsibility of the participant or their guardian. Participants are expected to carry their own health insurance.

Conduct and Dismissal

All participants are required to follow the rules and expectations established by the Activity, Camp Staff, and directors, as well as applicable laws. Failure to comply may result in dismissal from the camp.

In the event of dismissal, all travel and related expenses for returning the participant home are the sole responsibility of the participant or their guardian.

Liability Limitation

To the fullest extent permitted under California law, SCOTTISH FIDDLERS OF CALIFORNIA, ALASDAIR FRASER’S SIERRA FIDDLE CAMP, Shady Creek Outdoor School and Event Center, and their affiliates, managers, directors, officers, employees, staff, volunteers, agents, and representatives (collectively, “the Camp”) are not liable for any injury, loss, damage, or expense arising out of or related to participation in, or travel to and from, the Activity—even if caused in whole or in part by negligence.

California Civil Code § 1542 Notice

This disclaimer is intended to apply to all claims, whether known or unknown. California Civil Code § 1542 states:

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Participants waive, to the extent permitted by law, the protections of this section with respect to claims related to the Activity.

Indemnity

To the fullest extent permitted by law, participants (and/or their guardians) are responsible for any claims, damages, losses, costs, or expenses—including legal fees—arising out of their participation in the Activity, including those related to the possession or consumption of alcohol, except in cases of the Camp’s sole gross negligence or willful misconduct.

Severability

If any provision of these disclaimers is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Venue and Governing Law

Any claims related to the Activity shall be governed by California law and brought exclusively in Nevada County Superior Court in Nevada City, California.

Photography & Media Disclaimer

Video, sound recordings, and photographs may be taken during the course of the camp. These materials may include images or recordings of participants and may be used by the Camp or its affiliates in various media, including but not limited to websites, promotional materials, and publications, without compensation.

Participants who grant permission will have no ownership rights to such media. Granting permission is not required for attendance.

Participants (or their guardians) will be given the option to indicate whether they:

• Give permission for photographs and videos to be used by Sierra Fiddle Camp and/or its affiliates for publicity and fundraising purposes, including online and printed materials; or
• Do not give permission for such use.
